1. Introduction

Welcome to Easy & Fast, a registered Indian business operating under UDYAM Registration No. UDYAM-MH-21-0063074, with its principal place of business at Shop No. 57, Alibhai Tower, Shivaji Nagar, Nanded, Maharashtra – 431602.

These Terms & Conditions (“Terms”) govern your access to and use of our website, communication services, WhatsApp Official API services, RCS messaging services, and related digital solutions (collectively referred to as the “Services”).

By accessing or using our Services, you agree to be legally bound by these Terms. If you do not agree, you must not use our Services.

2. Definitions

For the purpose of these Terms:

  • “Company”, “We”, “Us”, or “Our” refers to Easy & Fast.
  • “User”, “Client”, or “You” refers to any individual, business, or entity using our Services.
  • “Platform” refers to our website, systems, dashboards, APIs, or integrations.
  • “WhatsApp Official API” refers to messaging services provided through Meta’s approved business platform.
  • “RCS” refers to Rich Communication Services messaging through telecom operators and supported platforms.
  • “Applicable Law” refers to laws in force within the Republic of India.

3. Acceptance of Terms

By registering, accessing, or using any of our Services, you confirm that:

  • You are legally capable of entering into binding agreements under Indian law.
  • You agree to comply with these Terms.
  • You will adhere to Meta Business Policies and telecom regulatory guidelines applicable to RCS and messaging services.

These Terms constitute a legally binding agreement between you and Easy & Fast.

4. Description of Services

Easy & Fast provides digital communication and messaging enablement services, including:

  • WhatsApp Official API onboarding and integration
  • RCS messaging enablement
  • Business messaging automation
  • Bulk notifications and transactional alerts
  • Customer engagement solutions
  • Related technical and support services

We do not control Meta, WhatsApp, Google, telecom operators, or their network infrastructure. Service availability may depend on third-party platforms.

5. Eligibility

To use our Services, you must:

  • Be at least 18 years of age.
  • Be legally authorized to represent your business (if applicable).
  • Provide accurate registration details.
  • Comply with Indian laws including the Information Technology Act, 2000 and Telecom Regulatory Authority of India (TRAI) guidelines.

We reserve the right to deny Services to any entity involved in prohibited or unlawful activities.

6. Account Registration

Users may be required to create an account. You agree to:

  • Provide accurate and updated information.
  • Maintain confidentiality of login credentials.
  • Notify us immediately of unauthorized use.
  • Accept responsibility for all activities under your account.

We reserve the right to suspend or terminate accounts containing false or misleading information.

7. User Responsibilities

You agree that you will NOT use our Services for:

  • Spam or unsolicited marketing
  • Fraudulent activities
  • Adult, gambling, crypto scams, or prohibited content
  • Political manipulation or misinformation
  • Hate speech, harassment, or unlawful promotions

You must obtain proper user consent before sending marketing or promotional messages via WhatsApp or RCS.

Violation may result in immediate suspension without refund.

8. Payment & Billing Terms

  • All fees must be paid in advance unless otherwise agreed.
  • Pricing may vary based on usage, template approvals, and message categories.
  • Taxes (including GST) shall be charged as applicable.
  • Payments once made are non-refundable unless required by law.

Failure to pay may result in suspension or termination of Services.

9. Subscription Renewal & Termination

Subscriptions may renew automatically unless cancelled prior to renewal.

Easy & Fast may suspend or terminate services:

  • For policy violations
  • For non-payment
  • For legal or regulatory requirements

Users may request termination by written notice via email.

Upon termination, access to platform services may cease immediately.

10. Use of WhatsApp Official API & RCS

Users acknowledge:

  • WhatsApp services are governed by Meta’s policies.
  • RCS services are subject to telecom operator regulations.
  • Message templates must be pre-approved.
  • Users must obtain customer opt-in consent.

Easy & Fast is not responsible for bans or restrictions imposed by Meta or telecom providers due to client misuse.

11. Message Delivery & Compliance Policy

Message delivery depends on:

  • Network availability
  • Customer device compatibility
  • Telecom operator systems
  • Platform restrictions

We do not guarantee 100% message delivery.

Clients are responsible for ensuring compliance with:

  • TRAI regulations
  • IT Act 2000
  • Meta Commerce & Business policies
  • Anti-spam laws

12. Intellectual Property Rights

All software, systems, dashboards, and materials provided by Easy & Fast remain our intellectual property.

Users are granted a limited, non-exclusive, non-transferable license to use our Services.

You may not:

  • Reverse engineer
  • Copy or reproduce software
  • Resell services without authorization

13. Confidentiality

Both parties agree to protect confidential information shared during the course of business.

Confidential information shall not be disclosed to third parties without prior written consent, except where required by law.

14. Disclaimer of Warranties

Services are provided “as is” and “as available”.

We do not warrant:

  • Uninterrupted availability
  • Error-free performance
  • Guaranteed message delivery
  • Third-party platform uptime

All implied warranties are disclaimed to the maximum extent permitted under Indian law.

15. Limitation of Liability

To the maximum extent permitted by law:

Easy & Fast shall not be liable for:

  • Indirect or consequential damages
  • Loss of business, revenue, or data
  • Third-party platform bans
  • Network failures

Total liability shall not exceed the amount paid by the client in the preceding three (3) months.

16. Indemnification

You agree to indemnify and hold harmless Easy & Fast, its directors, employees, and partners from any claims arising from:

  • Violation of laws
  • Breach of these Terms
  • Misuse of messaging services
  • Spam or policy violations

17. Governing Law (India)

These Terms shall be governed by and interpreted in accordance with the laws of India.

Any disputes shall be subject to the exclusive jurisdiction of courts located in Nanded, Maharashtra.

18. Changes to Terms

We reserve the right to modify these Terms at any time.

Updated Terms will be published on our website. Continued use of Services constitutes acceptance of revised Terms.
